# 0013: AGPLv3 again, owned by Pwnera SAS

> Accepted, v1.5. Replaces 0011.

## Context

[0011](/decisions/0011-elastic-license) left the AGPLv3 of
[0009](/decisions/0009-agpl-and-ee) for the Elastic License 2.0, so that
nobody could resell the hosting. That guards against a threat artbucket
doesn't have yet, and it costs now: self-hosted tools are found through open
source channels (lists, searches, contributors) that leave source-available
projects out. The AGPL still deters the large companies that would resell
it. Elastic and Redis both added it back after their source-available
licenses got them forked.

The copyright also named a person, not Pwnera SAS, the company behind
artbucket.

## Decision

Everything in this repository is under the
[GNU AGPLv3](https://www.gnu.org/licenses/agpl-3.0.html), version 3 only,
except `ee/`, which stays reserved for a commercial license, as in 0009.
Pwnera SAS holds the copyright.

A pull request comes with the contributor terms in
[CONTRIBUTING.md](https://github.com/pwnera/artbucket/blob/main/CONTRIBUTING.md):
the author keeps their copyright and gives Pwnera SAS the right to license the
contribution under any terms. That keeps Pwnera SAS able to license artbucket
commercially, to whoever cannot take the AGPL.

## Consequences

* Artbucket is open source again, by the OSI definition.
* Anyone may run it as a paid service, as long as they give their users the
  source of their changes: the cost 0011 avoided, accepted.
* A company whose policy rules out the AGPL can buy a commercial license from
  Pwnera SAS.
* Releases published under the Elastic License 2.0 keep it.
* `ee/` and the line drawn in [0006](/decisions/0006-grants-and-free-sso) are
  unchanged.
